The Momentum Energy Origination Suite is a platform operated by Digital Bar LLC. This Privacy Policy describes how Digital Bar handles information collected through Momentum Energy.
Digital Bar LLC ("Digital Bar," "we," "us," or "our"), operator of the Momentum Energy Origination Suite ("Momentum Energy," "Momentum," or "the Platform"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you:
- Visit the Momentum Energy website
- Create a Momentum Energy account
- Use the Momentum Energy platform, including the Atlas Map, scoring tools, rubric library, and AI features
- Connect data sources or integrate with internal or external APIs
- Interact with Momentum Energy applications, dashboards, or tools
This Privacy Policy also explains how Digital Bar handles Customer Data processed on behalf of our customers. By accessing or using the Services, you agree to this Privacy Policy.
1. Definitions
"Services" — The Momentum Energy platform, website, APIs, AI scoring and analysis features, Atlas Map, rubric library, strategy management, integrations, storage, and related features operated by Digital Bar LLC.
"Customer" — The business or individual who creates a Momentum Energy account and deploys the Services.
"End Users"— Members of a Customer's team (e.g., originators, analysts, leadership) who access the Customer's Momentum Energy account.
"Customer Data" — Content, data, configurations, portfolio information, scoring rubrics, strategies, integration payloads, prompts, AI outputs, metadata, and any other information submitted to or generated through the Services by or on behalf of a Customer.
2. Controller vs. Processor Role
Digital Bar operates Momentum Energy under a hybrid model:
Digital Bar is a Controller for:
- Account registration information
- Billing and payment data
- Website visitor data (cookies, analytics, logs)
- Security and diagnostic logs
- Communications sent directly to Digital Bar or Momentum Energy support
- First-party marketing and product analytics
- Fraud prevention
Digital Bar is a Processor / Service Provider for Customer Data, meaning:
- Customer controls the data
- Customer is responsible for providing notices, obtaining required consents, and defining lawful use
- Digital Bar processes Customer Data only as instructed
- Digital Bar does not use Customer Data for advertising, public-model training, or our own purposes (except security and platform maintenance)
This division matches the Terms & Conditions and applicable law.
3. Information We Collect
A. Information You Provide to Us (Controller Role)
- Name, email, phone number
- Company information and role
- Account credentials
- Billing and payment information
- Support communications
- Feature requests and feedback
B. Information Collected Automatically
- IP address and geolocation metadata
- Browser type and device identifiers
- Usage activity and log data
- Cookies, pixels, and analytics data
- Access dates and times
C. Information We Process on Behalf of Customers (Processor Role)
Includes, but is not limited to:
- Operating asset and portfolio data (locations, capacities, technologies, COD timing, interconnection status)
- Pipeline data (projects in development, capacity availability, excess)
- Custom scoring rubrics and sourcing strategies
- Strategy configurations and evaluation gates
- RFP and solicitation data ingested from public sources at Customer's direction
- Notes, comments, and annotations on opportunities
- AI-generated outputs (fit scores, narrative analysis, named risks, recommended actions, proposal recommendations)
- Workflow and configuration data
- API payloads exchanged with Customer-connected systems
- End User account identifiers and activity within the Customer's tenant
- Any other data a Customer inputs, uploads, or generates within the Platform
Digital Bar processes this information solely to provide the Services.
4. How We Use Information (As Controller)
Digital Bar uses personal information to:
- Provide and maintain the Services
- Authenticate users
- Process payments and prevent fraud
- Provide customer support
- Improve, optimize, and analyze the platform
- Communicate product updates, marketing, and transactional notices
- Enforce our Terms & Conditions
- Comply with legal obligations
Digital Bar does not sell or share personal information for cross-contextual advertising.
5. How We Use Customer Data (As Processor)
Digital Bar processes Customer Data only to:
- Deliver the Services as configured by the Customer
- Ingest, score, analyze, and generate AI output against Customer-configured strategies and rubrics
- Render geographic visualizations via the Atlas Map
- Store and retrieve Customer Data
- Process configured workflows and integrations
- Maintain platform stability and security
- Prevent fraud and abuse
- Provide usage analytics to the Customer
We do NOT:
- Sell Customer Data
- Share Customer Data with advertisers
- Use Customer Data to train public AI models
- Use Customer Data for our own marketing or competitive purposes
- Share one Customer's portfolio, rubrics, or strategies with any other Customer
6. AI Scoring, Analysis & Recommendation Generation
Momentum Energy provides functionality for:
- Scoring RFPs against Customer portfolios using configurable strategies and rubrics
- Generating fit scores, narrative analysis, and named risks
- Producing AI-generated proposal recommendations
- Analyzing geographic relationships between RFPs and Customer assets
- Summarizing and surfacing RFP and solicitation content
Customers acknowledge that:
- AI outputs are decision-support, not authoritative determinations
- All outputs must be reviewed by qualified personnel before use in bid submissions, regulatory filings, or other material decisions
- Customer is responsible for ensuring AI outputs are accurate, complete, and appropriate for use in its specific context
- Customer is responsible for any disclosures required to counterparties, regulators, or end users regarding AI use
Digital Bar processes RFP, portfolio, and configuration data only as a processor, on behalf of the Customer.
7. Customer Responsibilities
Consistent with the Terms & Conditions, Customers are responsible for:
- Ensuring lawful collection and use of any personal data uploaded to the Platform
- Ensuring portfolio, asset, and pipeline data is accurate and authorized for processing
- Ensuring that scoring rubrics, strategies, and configurations are their own intellectual property or used with appropriate rights
- Compliance with applicable energy market and procurement regulations (FERC, ISO/RTO rules, public procurement integrity rules)
- Compliance with the terms of use of any third-party data source the Customer connects
- Providing privacy notices to End Users (team members) of the Customer's tenant
- Managing data retention policies within their account
- Honoring any data subject requests (access, correction, deletion) from individuals within the Customer's tenant or whose data the Customer has uploaded
8. How We Share Information
Digital Bar shares information in the following limited circumstances:
A. Service Providers (Processors / Sub-Processors)
We use trusted vendors to provide infrastructure, cloud hosting, AI model access, geospatial services, storage, analytics, and security. Sub-processors are bound by confidentiality and data-protection obligations consistent with this Policy.
B. Legal Compliance
We may disclose information where required by law, subpoena, or court order.
C. Protection of Digital Bar
We may disclose data to:
- Prevent fraud or abuse
- Enforce the Terms & Conditions
- Protect rights, security, or intellectual property
D. Business Transfers
If Digital Bar is acquired, merged, or reorganized, personal data may be transferred.
We do NOT sell personal information.
9. Data Retention
As Controller: We retain account-level data as long as necessary to provide the Services or comply with law.
As Processor: We retain Customer Data only as long as the Customer account remains active, unless otherwise required by law or contractually agreed.
Upon termination:
- Customer Data may be permanently deleted
- Digital Bar has no obligation to retain or return data unless contractually agreed
- Customer is responsible for exporting backups before termination
10. Security
Digital Bar uses reasonable administrative, technical, and physical safeguards to protect information processed by Momentum Energy, but no system is 100% secure.
Customers are responsible for securing access to their accounts, managing user permissions within their tenant, and protecting credentials for connected APIs and integrations.
11. International Transfers
Digital Bar and its sub-processors may process data in the United States or other countries. We use reasonable mechanisms (e.g., Standard Contractual Clauses) when required by applicable law.
12. Children's Privacy
The Services are not intended for children under 16, and Digital Bar does not knowingly collect children's personal information. Customers may not upload or process children's data in the Platform.
13. Your Privacy Rights
Depending on your jurisdiction, you may have rights to:
- Access, correct, or delete personal data
- Opt out of marketing communications
- Restrict certain processing
- Request a copy of your data
Requests may be submitted to: hello@digitalbar.ai.
These rights do not apply to Customer Data, which must be requested directly from the Customer (the data controller for that data).
14. Limitation of Liability
Digital Bar's liability is limited as described in the Terms & Conditions. This Privacy Policy does not expand or modify those liability limitations.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be communicated via the Service or by email.
